Monaé® Terms of Service

1. Agreement to Terms

By accessing, browsing, or using monaes.store in any capacity, or by completing a purchase through monaes.store, you ("the Customer," "you," "your") enter into a legally binding agreement with Monaé® ("we," "us," "our") and agree to be fully bound by these Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Legal Notice, all of which are incorporated into these Terms by reference.

If you do not agree to these Terms in their entirety, you must immediately cease all use of monaes.store and refrain from placing any orders. Your continued use of the Site or completion of a purchase constitutes your unconditional acceptance of these Terms.

These Terms apply to all visitors, browsers, customers, and any other users of the Site regardless of location, nationality, or method of access. Monaé® reserves the right to refuse service to any individual at any time and for any reason at its sole discretion.


2. Eligibility

By using monaes.store and placing an order, you represent and warrant that:

  • You are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater
  • You have the legal capacity and authority to enter into a binding contract
  • You are not prohibited by any applicable law from purchasing or receiving our products
  • All information you provide to us is accurate, truthful, and complete
  • You will not use the Site or our products for any unlawful or unauthorized purpose
  • You are the authorized holder of the payment method used to complete your purchase

Monaé® reserves the right to verify eligibility at any time and to cancel orders placed by individuals who do not meet these requirements.


3. Products & Orders

3.1 Product Descriptions Monaé® makes every reasonable effort to accurately describe its products on monaes.store. However, we do not warrant that product descriptions, images, pricing, or any other content on the Site is completely accurate, current, or error-free. Product images are for illustrative purposes only and minor variations in appearance may occur. In the event of an error in a product listing, Monaé® reserves the right to cancel the affected order and issue a full refund.

3.2 Order Acceptance Placing an order on monaes.store constitutes an offer to purchase. Your order is not confirmed or accepted until you receive an official order confirmation email from Monaé®. We reserve the right to refuse, cancel, or limit any order at any time for any reason including but not limited to suspected fraud, payment issues, product unavailability, or violations of these Terms. Receipt of an order confirmation email does not guarantee final acceptance if a subsequent issue is identified.

3.3 Pricing All prices displayed on monaes.store are in USD unless otherwise stated and are subject to change at any time without prior notice. Monaé® shall not be liable for any pricing errors on the Site. In the event that an order is placed at an incorrectly listed price, we reserve the right to cancel the order and notify the customer accordingly.

3.4 Payment Full payment is required at the time of purchase. Monaé® accepts major credit and debit cards, PayPal, Shop Pay, and other payment methods displayed at checkout. All payment transactions are processed securely through third-party payment processors. Monaé® does not store raw payment card data. By submitting a payment, you confirm that you are the authorized user of the payment method and that all payment information provided is accurate.

3.5 Order Cancellations Orders may only be cancelled before they have been fulfilled and dispatched. Once a tracking number has been assigned to your order, it can no longer be cancelled. Cancellation requests must be submitted immediately to hello@monaes.store with the subject line: Cancellation Request — Order #[your order number]. Monaé® cannot guarantee that cancellation requests will be processed in time and is not liable for orders that have already entered the fulfillment process at the time of the request.


4. Shipping & Delivery

All shipping and delivery matters are governed by our Shipping Policy, which is incorporated into these Terms by reference. By placing an order, you acknowledge and accept that:

  • Delivery timeframes are estimates only and are not guaranteed
  • Monaé® is not responsible for delays caused by carriers, customs authorities, weather, or other circumstances beyond our control
  • It is your sole responsibility to provide accurate and complete shipping information at checkout
  • Monaé® is not liable for orders delivered to incorrect addresses as a result of customer error
  • A package will not be considered lost until the full 20 business day delivery window has elapsed
  • Customs duties, import taxes, and related fees are the sole responsibility of the customer

5. Returns & Refunds

All return and refund matters are governed exclusively by our Return & Refund Policy, which is incorporated into these Terms by reference and forms a binding part of this agreement. By completing a purchase, you confirm that you have read and accepted our Return & Refund Policy in full.

Key conditions you expressly agree to at the time of purchase include:

  • Refunds are only available within 100 days of the confirmed delivery date
  • A minimum of 28 days of consistent documented use is required before any refund request will be considered
  • Photographic or video evidence of use must be submitted with any refund request
  • Monaé® reserves the right to deny any refund request that does not meet all eligibility criteria
  • Shipping fees are non-refundable under all circumstances
  • Only one refund is permitted per household

6. Chargebacks & Payment Disputes

This section is critically important and forms a binding part of your agreement with Monaé® at the time of purchase.

6.1 Agreement to Contact Monaé® First By completing a purchase on monaes.store, you expressly agree to contact Monaé® directly at hello@monaes.store and allow us a minimum of 10 business days to resolve any issue before initiating any chargeback, payment dispute, or claim with your bank, credit card provider, PayPal, or any other payment platform. Failure to contact us first and allow adequate time for resolution before initiating a dispute constitutes a breach of these Terms.

6.2 Documentation & Evidence In the event that a chargeback or payment dispute is initiated, Monaé® will provide the relevant financial institution or payment platform with full documentation to contest the dispute, including but not limited to:

  • Your order confirmation and payment receipt
  • Delivery confirmation and carrier tracking records showing confirmed delivery to the address provided at checkout
  • Your acceptance of these Terms, our Return & Refund Policy, and our Shipping Policy at the time of purchase
  • All communication records between you and Monaé®
  • Any evidence of product use or non-compliance with our refund eligibility requirements
  • IP address records and device data confirming your agreement to our Terms at checkout

6.3 Fraudulent Chargebacks A chargeback initiated where the product was delivered as described, where the customer has used the product, or where the customer has not followed the refund process outlined in our Return & Refund Policy will be considered a fraudulent chargeback. Monaé® will actively contest all fraudulent chargebacks and reserves the right to:

  • Permanently ban the customer from purchasing through monaes.store
  • Report the customer's details to fraud prevention databases and relevant payment networks
  • Pursue civil legal action to recover the disputed amount plus any associated chargeback fees, legal costs, and damages
  • Share evidence of fraudulent activity with relevant authorities where applicable

6.4 Chargeback Fees In the event that a chargeback is initiated and subsequently found to be unjustified or fraudulent, the customer agrees to reimburse Monaé® for any chargeback fees, administrative costs, and legal fees incurred as a result of the dispute. This obligation survives the termination of any purchase agreement between the customer and Monaé®.

6.5 Good Faith Resolution Monaé® is committed to resolving all genuine customer concerns fairly and promptly. We strongly encourage all customers to contact us at hello@monaes.store before initiating any dispute. In the vast majority of cases, contacting us directly results in a faster and more satisfactory resolution than a formal dispute process.


7. Results Disclaimer

Results from use of the CelluGlow™ device vary between individuals and are not guaranteed. Testimonials and before and after content displayed on monaes.store or in our marketing materials reflect individual experiences and are not representative of typical results. Factors including frequency of use, consistency, body type, age, skin condition, lifestyle, and overall health all influence individual outcomes.

CelluGlow™ is a personal care device and is not a medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition or disease. Nothing on monaes.store constitutes medical advice. Customers with pre-existing medical or skin conditions are advised to consult a qualified medical professional before use. Monaé® accepts no liability for outcomes that do not meet personal expectations where the product has been used as directed.


8. Intellectual Property

All content on monaes.store including text, images, graphics, logos, video, product names, and all other materials are the exclusive intellectual property of Monaé® and are protected under applicable copyright and trademark law. The Monaé® name and CelluGlow™ product name are proprietary trademarks of Monaé®.

You may not reproduce, copy, distribute, republish, upload, transmit, or exploit any content from monaes.store without the prior express written consent of Monaé®. Any unauthorized use of our intellectual property will be pursued to the fullest extent permitted by law.


9. Prohibited Conduct

By using monaes.store you agree that you will not:

  • Use the Site for any unlawful, fraudulent, abusive, or harmful purpose
  • Submit false, misleading, or fraudulent orders, refund requests, or chargeback claims
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems
  • Scrape, harvest, or extract data from the Site without prior written authorization
  • Transmit viruses, malware, or any other harmful or disruptive code through the Site
  • Use the Site in any way that could damage, disable, or impair its functionality
  • Harass, threaten, intimidate, or abuse any Monaé® employee, representative, or agent in any communication channel

Monaé® reserves the right to suspend or permanently ban any user found to be in violation of these conditions and to pursue all available legal remedies.


10. Limitation of Liability

To the fullest extent permitted by applicable law, Monaé® and its owners, directors, employees, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind arising from or in connection with:

  • Your use of or inability to use monaes.store
  • Your purchase or use of any Monaé® product
  • Any errors, inaccuracies, or omissions in the content of the Site
  • Any shipping delays, delivery failures, or customs issues
  • Any results or outcomes from product use that do not meet personal expectations
  • Any unauthorized access to your data or communications
  • Any third-party content, services, or links accessed through the Site

In no event shall Monaé®'s total cumulative liability to any customer exceed the total amount paid by that customer for the specific order giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.


11. Indemnification

You agree to indemnify, defend, and hold harmless Monaé® and its owners, directors, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses including reasonable legal fees arising out of or in connection with:

  • Your use of monaes.store
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your submission of false, fraudulent, or misleading information
  • Any fraudulent chargeback or payment dispute initiated by you
  • Any third-party claim arising from your conduct on or through the Site

12. Governing Law & Dispute Resolution

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Alabama, United States of America, without regard to its conflict of law provisions.

In the event of any dispute arising from these Terms or your use of monaes.store, the parties agree to first attempt resolution through good faith negotiation for a period of 30 days. If the dispute is not resolved through negotiation, it shall be submitted to binding arbitration before any court proceedings are commenced. The arbitrator's decision shall be final and binding on both parties.

You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Monaé®. All disputes must be brought in your individual capacity only.

Nothing in this section prevents Monaé® from seeking urgent injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or other proprietary rights.


13. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions, which shall continue in full force and effect.


14. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Legal Notice, constitute the entire agreement between you and Monaé® with respect to your use of monaes.store and supersede all prior or contemporaneous agreements, representations, warranties, and understandings of any nature.


15. Waiver

The failure of Monaé® to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will only be effective if made in writing and signed by an authorized representative of Monaé®.


16. Amendments

Monaé® reserves the right to update, modify, or replace these Terms at any time without prior notice. The version of these Terms in effect at the time of your purchase governs your order. Your continued use of monaes.store following any amendments constitutes your acceptance of the revised Terms. It is your sole responsibility to review these Terms periodically.
